Terms of Use:
The access and use of trimenergy.com.au (“the website”) is subject to the following terms and conditions (“The Terms”) set forth. By accessing and using the website, you agree to The Terms. Any of the following references “we”, “us”, “our”, “Trim Energy” made in this statement is understood to mean trimenergy.com.au. We reserve the right to modify The Terms, at our discretion, and at any time.
Title & Risk:
All products purchased on trimenergy.com.au shall remain the property of Trim Energy until they have been fully paid for. We are not obligated to despatch and deliver any product for which payment has not been received in full. Title to and risk in the products will pass to you upon delivery from us.
Prices:
All prices on this website are in Australian dollars (AUD) and are inclusive of GST (goods and services tax). We reserve the right to modify prices published on our website at any time.
Product Availability:
We make our best efforts to satisfy your order, however if for any reason beyond our control we are unable to supply the ordered items we will notify you via email. In this case your items will be placed on backorder, or you have an option to remove that item from your order for a full refund.
Delivery Information:
Trim Energy endeavours to despatch all goods within 48 hours (2 business days). Shipping costs are determined by the total weight and dimensions of your order as well as your location. Shipping costs are calculated during the checkout process where the exact shipping cost is displayed. Estimated shipping time can vary depending on your location and preference of delivery type, Australia Post Standard or Express delivery.
Returns Policy:
Every effort is made to ensure all our products are of the highest standard and quality and are supplied to you free from any damage or defect. Should any item be damaged or faulty you must contact Trim Energy within 7 days of delivery. Damaged or faulty items returned for warranty must be accompanied by a proof of purchase, and will be replaced free of charge.
Product Warranty:
All our products carry a 2-year manufactures warranty against defects in workmanship and materials, except were otherwise stated. The warranty service is limited to the replacement or repair of products that become defective under normal use, as determined by Trim Energy. Damaged or faulty items must be returned to Trim Energy by the purchaser of the products who is also responsible for the postage costs associated with the warranty claim. All items being returned for warranty must also be accompanied by a proof of purchase.
This warranty does not cover LED lights that have been battered, disassembled, installed in a fully enclosed lighting fixture, or used in association with iron core or standard electronic transformers. Any liability for indirect, incidental or consequential damages arising from the failure of the Lamp is excluded.
LED Lifetimes:
All stated lifetimes for LED products cover the lifetime of the entire LED Lamp, not just the lifetime of the LED device itself. Stated lifetimes are based on average lifetimes and do not constitute a guarantee nor are they part of the product warranty. LED lifetimes can be reduced if not run in optimal conditions.
Compatibility of Transformers for LED lamps:
LED MR16 GU5.3 replacement lamps are designed to directly replace MR16 GU5.3 halogen lamps in their existing fittings, which are powered by existing transformers. However not all existing transformers used to drive halogen MR16 GU5.3 lamps are compatible with LED MR16 GU5.3 replacement lamps. This is clearly evident with obvious flickering of the LED MR16 lamp. Only LED specific Transformers can guarantee correct operation of the LED lamp. Trim Energy will not accept any responsibility for consumers that purchase MR16 LED GU5.3 lamps that are not compatible with their existing transformers, no refunds will be offered.
Limitation of Liability:
Information contained on this site is provided by Trim Energy in good faith. Trim Energy relies on the information provided by its suppliers and manufacturers in order to assess products and may not have any prior knowledge of any errors or omissions until we are notified. You acknowledge that such information and materials may contain inaccuracies or errors and we exclude liability for any loss or damage, however caused (including negligence), which may be suffered whether directly or indirectly, in connection with the use of the website.
Without limiting the general disclaimer, Trim Energy:
- Does not provide any warranty or guarantee on the accuracy, performance, completeness or suitability of information on this website for any particular purpose nor do we accept any responsibility arising in any way (including by negligence) for errors in, or omissions from, the information.
- Makes no warranty as to the merchantability or fitness of its products for a particular purpose
- Is not liable for disruptions to the website
- Is not liable to you or anyone else for damage to your computer systems in connection with the use of the website or an external site.
Trim Energy will not be liable for any loss or damage incurred by the Customer or End User from products damaged as a result of negligence, alteration, accident, improper installation or replacement, repair, installation not conducted by certified installer(s), use of the products in any way which does not comply to relevant standards, or use of the products in any way for which the products were not designed or approved by Trim Energy. All installations must be conducted by a qualified installer and must comply with all relevant Australian Standards. All electrical work must be conducted by a qualified electrician.
To the extent permitted by law our total liability herein in respect of each event or series of connected events shall not exceed the total price paid for the purchase of products and/or services under these Terms and Conditions.
External information and Websites:
We provide external information, advertisements and links to other websites which are not under the control of Trim Energy and we accept no responsibility for the behaviour of those companies/websites and do not endorse any content that they may contain. Please refer to that website’s terms of use and privacy statements should you need more information.
